Looks like Major Hasan is headed to trial with a sentence of death being a possible penalty. WASHINGTON — A senior US commander has recommended that Major Nidal Hasan face the death penalty over a 2009 shooting rampage at Fort Hood military base that killed 13 people, the US Army said. The recommendation for a general court-martial by Fort Hood brigade commander Colonel Morgan Lamb will go to Lieutenant General Robert Cone, the base commander, according to the military. “We can confirm that Lamb did recommend that the charges pending against Hasan be sent to a general court-martial authorized to consider capital punishment,” the US Army said in a statement late Friday. He won't using his wheelchair to "walk the mile" anytime soon because there are some procedural things that have to take place now, because the death penalty is officially involved, and there are some T's to cross. 1. There must be a Members Panel (jury) of at least 12 persons. 2. The accused cannot plead guilty. 3. The accused cannot be tried by military judge alone. 4. Depositions cannot be used as evidence. 5. A finding of guilty must be by a unanimous secret written ballot. 6. A sentence to death must be unanimous by secret written ballot. 7. There is an automatic appeal up to and including the Court of Appeals for the Armed Forces. 8. It is the president of the United States acting as commander-in-chief who approves the death sentence and signs the death warrant. I do hope that throughout this trial that we don't have to hear ad nauseum from people like General Schoomaker about how "we can't let our diversity become a casualty" or some other BS. The mind boggling stupidity of such a statement still astounds me. Note to General Schoomaker; diversity is the last thing I gave a crap about when I was wearing the uniform and I bet that I wasn't alone, but it sure seemed like that mattered to someone in Major Hasan's chain of command. I do hope that the officers that were absolutely derelict in their duty are in for some career ending treatment as well. I am not certain with this current president we will get someone with the level of spine and follow through to do what is necessary to carry out the sentence. And we have the problems with the usual cast of unindicted co-conspirators (CAIR, the ACLU, the Innocence Project, Anti Death Penalty groups of all flavors) who will no doubt make trouble. All of them need to keep this in mind; there are 13 souls this guy needs to burn in hell for, and your righteous argument that it isn't up to us to judge his immortal soul is absolutely correct, but it is up to us to arrange the meeting. The US Disciplinary Barracks may need someone to pull the lever (Hanging is still the way we git'r done) or help line up the firing squad and load their magazines and get this traitor on his way to see the doorman behind the velvet rope at Club Hell. I am certain he can get a room in the martyr section I will ensure my calendar is clear so I am available, just in case they need me on that day. jm
